There is ample science to support an instruction for evaluating expert cognitive bias. Whatever tool(s) a judge selects, given the accused’s constitutional right to confrontation and to present a defense, and a court’s duty to ensure a reliable verdict, evidence of cognitive bias of experts and its impact must be admissible and made meaningful.
